1. Agreement to Terms

These Terms and Conditions ("Terms") constitute a legally binding agreement between you ("Customer," "you," "your") and Heva Living — Lifestyle Store ("we," "us," "our"), operating at www.hevaliving.com. By accessing this website or placing an order, you confirm that you have read, understood, and agree to be bound by these Terms, along with our Privacy Policy and Shipping & Refund Policy.

If you do not agree to these Terms, you must not use this website or make any purchases.

2. Eligibility

You must be at least 18 years of age (or the age of majority in your jurisdiction) to make a purchase. By placing an order, you represent and warrant that you meet this requirement and have the legal capacity to enter into a binding contract.

3. Products

All products sold through Heva Living — Lifestyle Store are made to order. Each item is crafted after purchase using premium materials and professional production processes. We describe dimensions, materials, and colors as accurately as possible; however, slight variations may occur due to differences in monitor calibration, colour profiles, and printing processes. Such variations do not constitute a defect.

4. Pricing & Payment

All prices are listed in United States Dollars (USD) unless otherwise indicated. Payment is processed securely through Stripe. Full payment is required at the time of purchase. We reserve the right to update pricing at any time; however, price changes will not affect orders already placed.

You are responsible for any applicable taxes, duties, or import fees imposed by your country or jurisdiction. These are not included in our prices and are the responsibility of the buyer.

5. Order Formation

Placing an order constitutes an offer to purchase. A binding contract is formed only when we accept your order by processing payment and sending you an order confirmation email. We reserve the right to refuse or cancel any order for reasons including pricing errors, suspected fraud, or product unavailability.

6. Production & Shipping

All prints are produced on demand after purchase. Production and shipping typically take 5 to 12 business days. You will receive a shipping confirmation email with tracking information once your order has been dispatched. Delivery times may vary based on your location and customs processing.

Risk of loss and title for items pass to you upon delivery to the carrier. We are not responsible for delays caused by shipping carriers, customs, or events beyond our control.

7. Returns, Refunds & Cancellations

Due to the made-to-order nature of our products, all sales are final. Refunds and returns are generally not available. However, if your print arrives damaged or defective, we will provide a free replacement. See our Shipping & Refund Policy for full details, including your cancellation window and quality guarantee.

EU/EEA Consumers: Under EU consumer law, made-to-order and personalised goods are exempt from the standard 14-day withdrawal right (Directive 2011/83/EU, Article 16(c)). Because each print is produced specifically for your order, the right of withdrawal does not apply once production has commenced. You retain all other statutory consumer rights under applicable law.

8. Intellectual Property

All images, content, artwork, logos, and trademarks displayed on this website are the intellectual property of Heva Unique Art Gallery and/or the original artist. Purchasing a print grants you a personal, non-commercial license to display it. Reproduction, distribution, modification, or commercial use without prior written consent is strictly prohibited.

9. User Conduct

You agree not to:

• Use this website for any unlawful or fraudulent purpose
• Attempt to gain unauthorised access to our systems or data
• Interfere with or disrupt the website's functionality
• Submit false, misleading, or defamatory content through our contact form
• Scrape, crawl, or use automated tools to extract content without permission

10. Limitation of Liability

To the maximum extent permitted by applicable law, Heva Unique Art Gallery shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising from your use of this website or purchase of artwork.

Our total aggregate liability for any claim arising from or related to a purchase shall not exceed the purchase price of the artwork in question.

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including liability for death or personal injury caused by negligence, fraud, or fraudulent misrepresentation.

11. Disclaimer of Warranties

This website is provided on an "as is" and "as available" basis. We make no warranties, express or implied, regarding the website's availability, accuracy, or fitness for a particular purpose. This disclaimer does not affect your statutory consumer rights.

12. Force Majeure

We shall not be liable for any delay or failure to perform our obligations where such delay or failure results from circumstances beyond our reasonable control, including but not limited to natural disasters, pandemics, war, terrorism, strikes, government actions, supply chain disruptions, or failures of third-party services.

If you are a consumer in the EU/EEA or UK, you retain the benefit of any mandatory provisions of the consumer protection laws of your country of residence.

15. Severability

If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall remain in full force and effect.
